Manslaughter charge against Daniel Penny, other charges being considered
Daniel Penny, the man who intervened on a New York City subway train while Jordan Neely was threatening passengers, scored a massive legal victory that continued the high-profile case.
According to Breitbart, the manslaughter charge Penny was facing was dismissed in court last week after a tumultuous court case that quickly became political.
Penny even had the backing of New York City Mayor Eric Adams, who said Penny simply acted in a way that any New Yorker should have while Neely was threatening the safety of innocent subway passengers.
Those against Penny believe he acted inappropriately and many of those same people somehow accused Penny of being "racist" or a "bigot" because Neely happened to be a Black man, and homeless.
What happened?
After several days of deliberation, a Manhattan jury was unable to come to a consensus on whether or not to convict Neely on the manslaughter charge.
The jury was also instructed to reach an "Allen charge," which is an order given to the jury to come to a unanimous verdict of either guilty or not guilty.
Daniel Penny has departed the courthouse after his manslaughter charge was dismissed.

Penny had placed Neely in a chokehold and the homeless man later died. However, bombshell testimony showed that Neely was still alive when police responded to the scene.

The defense wanted Judge Maxwell Wiley to declare a mistrial, but prosecutors moved that the manslaughter charge be dismissed instead, urging the judge to allow the jury to consider a “lesser included” charge of negligent homicide.
Fox News noted:
The charge requires prosecutors to prove that Penny acted with recklessness when he grabbed Jordan Neely in a chokehold. Neely had barged onto the train while high on drugs, threatening to kill passengers during a psychotic episode, according to trial testimony.

Users across the social media spectrum weighed in on the matter and many shared their thoughts on the outcome of the trial, so far.
"What the prosecutor and judge are doing is evil. After giving the jury instructions they dropped the manslaughter charge to push the jury to a compromise verdict. This is wrong," one X user wrote.
Another X user wrote, "I am crying over this. He did what I would have wanted someone to do if I was riding that subway that very moment this happened. Praying the second charge is dismissed."
Many hope that Penny is ultimately found innocent of all the charges he faces. Only time will tell.
