Mayorkas to reinstate 'sanctuary country' rules after Supreme Court ruling

Department of Homeland Security Secretary Alejandro Mayorkas plans to reinstate its sanctuary country orders after a ruling this week by the Supreme Court.

The rules will shield most of the nation's migrants crossing the southern border from deportation.

The statement

"DHS looks forward to reinstituting these guidelines, which had been effectively applied by U.S. Immigration and Customs Enforcement officers to focus limited resources and enforcement actions on those who pose a threat to our national security, public safety, and border security," Mayorkas said in a statement.

"The guidelines enable DHS to most effectively accomplish its law enforcement mission with the authorities and resources provided by Congress," it added.

New rules

"The U.S. Department of Homeland Security (DHS) announced this week that it will be rescinding the Trump administration’s terminations of Temporary Protected Status (TPS) for El Salvador, Honduras, Nepal, and Nicaragua," the Center for Immigration Studies reported.

"The Department also announced that the DHS Secretary will be extending these countries’ TPS designations for an additional 18 months but, notably, not 'redesignating' them, which would have expanded the pool of potential beneficiaries by allowing aliens who entered the country after the most recent designation to be eligible for TPS protection from removal and work authorization," it added.

The decision

The moves come as the Supreme Court ruled states can't sue the federal court to force the government to crack down on migrants at the border.

"States can’t use the federal courts to try to force the federal government to arrest and deport more people who are in the country illegally, the Supreme Court ruled Friday," Politico wrote following the decision.

"The 8-1 decision could cut down on a flood of lawsuits recent administrations have faced from state attorneys general and governors who disagree with Washington on immigration and crime policy," it added.

Texas and Louisiana were involved in the lawsuit that found its way to the Supreme Court in the latest battle.

The move now allows Mayorkas and the Biden administration to continue its open border policies that will further hurt the nation.
