Nevada federal judge rejects anti-Trump 14th Amendment ballot removal lawsuit

A federal judge in Nevada just dismissed a 14th Amendment lawsuit filed by a longshot anti-Trump Republican "candidate" who aims to see former President Donald Trump disqualified from the Silver State's primary election ballot, according to The Hill.

The supposed candidate, John Anthony Castro, who has filed 14th Amendment-related Trump ballot removal lawsuits in multiple states, was found by the judge to lack proper standing to bring the lawsuit in Nevada.

In fact, the judge determined that Castro was not a legitimate "political competitor" against the former president and, as such, "improperly manufactured his standing merely to file this lawsuit."

Lawsuit dismissed for lack of standing

In a four-page ruling on Monday, U.S. District Judge Gloria Navarro, an Obama appointee, dismissed the lawsuit filed in Nevada by Castro that raised the "politically charged question" of former President Trump's eligibility for public office under Section 3 of the 14th Amendment of the U.S. Constitution.

Created in the aftermath of the Civil War, the 14th Amendment's Section 3 was intended to bar former Confederate officers and politicians who'd previously sworn an oath to uphold the U.S. Constitution from holding any public office again in the newly reconstituted union of states after engaging in an "insurrection or rebellion."

Previously rarely invoked, that clause is now often cited by Trump's fiercest critics and opponents as rendering him disqualified to run for or hold office due to his alleged incitement of and support for the "insurrection" that was the Jan. 6 Capitol riot of 2021.

Unfortunately for Castro, the purported merits of his arguments for why Trump is disqualified under the 14th Amendment were never considered by the judge since it was determined that he lacked standing to bring the lawsuit in the first place.

Indeed, Navarro noted in her ruling that Castro had already seen similar lawsuits be similarly rejected for lack of standing by federal judges in five other states -- Arizona, Florida, New Hampshire, Rhode Island, and Washington D.C.

Castro "improperly manufactured" his supposed standing

In an effort to establish standing, Castro has asserted that he is a "political competitor" and primary candidate against former President Trump who will suffer the "injury" of receiving fewer votes if Trump appears on the ballot.

However, Judge Navarro referenced the other dismissals and wrote, "In rejecting his political competitor standing argument, courts have found that Castro improperly manufactured his standing merely to file this lawsuit."

Ironically, the judge also referenced an Associated Press article Castro had submitted with the court ostensibly in his support that Navarro subsequently used against him, as he was quoted in the piece about his registration for the New Hampshire primary, "I’m not going to lie and pretend my candidacy is anything more than trying to enforce the United States Constitution, and that’s what I’m here to do."

In response to the Nevada dismissal, Trump campaign spokesman Steven Cheung said in a statement, "Today’s dismissal of another bogus, bad-faith, Crooked Joe Biden-engineered attempt to deprive Americans as a whole, and the voters of Nevada specifically, of their right to vote for the candidate of their choice is not only a victory for President Trump, but a victory for all Americans and the people of Nevada."

"President Trump remains undefeated in federal court against these cynical efforts to interfere in the 2024 election," he continued. "Courts in eleven states have now dismissed similar, pathetic, 14th Amendment ballot cases."

"Make no mistake, each and every one of these 'ballot-challenges' are blatant attempts to steal the election for Crooked Joe Biden and disenfranchise over 100 million American voters. President Trump is the leading candidate for not only the Republican primary, but the general election and his opponents are desperate. Rest assured that he will fight each and every one of these disgraceful attacks on American democracy, he will win, and we will all Make America Great Again," the spokesman added.
