New Jersey Democratic congresswoman charged with assaulting ICE agent

Newark Mayor Ras Baraka was arrested earlier this month for criminal trespass when he and other Democrats attempted to enter an Immigration and Customs Enforcement (ICE) facility.

Baraka isn't alone in facing legal consequences over the incident, as a Democratic member of Congress has also been charged with assault. 

Altercation caught on video

According to Breitbart, New Jersey Rep. LaMonica McIver stands accused of attacking a federal agent at the Delaney Hall ICE detention facility.

Secretary of Homeland Security Kristi Noem announced that McIver had been charged in a social media post put out on Monday.

"After a thorough review of the video footage of Delaney Hall and a full investigation from HSI, the U.S. Attorney for the District of New Jersey had made the determination to charge Congresswoman LaMonica McIver for assaulting, resisting, and impeding law enforcement officers," Noem wrote.

"No one is above the law," she continued before adding, "If any person, regardless of political party, influence or status, assaults a law enforcement officer as we witnessed Congresswoman McIver do, you will be prosecuted to the fullest extent of the law."

Acting U.S. attorney pledges to protect law enforcement

Those remarks echoed a similar statement issued on Monday by acting U.S. Attorney for the District of New Jersey Alina Habba.

Habba wrote in a social media post of her own that McIver "assaulted, impeded, and interfered with law enforcement in violation of Title 18, United States Code, Section 111(a)(1)."

"That conduct cannot be overlooked by the chief federal law enforcement official in the State of New Jersey, and it is my Constitutional obligation to ensure that our federal law enforcement is protected when executing their duties," she insisted.

However, Habba also announced that Mayor Baraka's trespass charge was being dismissed "for the sake of moving forward."

Habba offers to take Baraka on a tour of facility

"In the spirit of public interest, I have invited the mayor to tour Delaney Hall. The government has nothing to hide at this facility, and I will personally accompany the mayor so he can see that firsthand,"' Habba explained.

"The citizens of New Jersey deserve unified leadership so we can get to work to keep our state safe," the acting U.S. attorney asserted.

She concluded by saying, "The dismissal against the mayor is not the end of this matter. Congressional oversight is an important constitutional function and one that I fully support. However, that is not at issue in this case."
