Pardon could result in Hunter Biden being called as a witness in Biden family investigations
Hunter Biden might be celebrating the fact that his father, President Joe Biden, issued a sweeping pardon that gives him immunity for an 11-year period and saves him from a prison sentence, but his legal troubles might just be starting, legal experts say.
According to the Daily Mail, now that Hunter Biden essentially has federal immunity for that time period, he can no longer claim the Fifth Amendment, and could be a key witness in other cases for years to come.
The Fifth Amendment is a Constitutional right that affords protection to people from offering testimony that could lead to self-incrimination.
Legal mind Alan Dershowitz wrote for the Daily Mail, "Since Hunter is now effectively immune from federal prosecution, he cannot plausibly claim that testimony could constitute self-incrimination."
What's going on?
The fact that Hunter Biden could plausibly be a witness in other Biden family-related cases is a massive win for President-elect Donald Trump's incoming attorney general, Pam Bondi.
Dershowitz points out that if Bondi should choose to open a case into other Biden family members over alleged foreign influence peddling cases or something similar, she could call Hunter Biden as a witness.
He noted:
One Republican-led House committee has estimated that the Bidens and their business associates have raked in more than $27 million in overseas business deals in recent years. However, not a single Biden family member has ever registered as a 'foreign agent' as may be required by law.
The lawyer went on to describe that situation as "fertile ground" for a future investigation, led by Trump's DOJ.
It was also noted that while the pardon protects Hunter Biden from criminal prosecution, it doesn't shield him from civil litigation, which encompasses potential fraud charges.
Dershowitz said that "the post-presidency outcome for the Biden family is fraught, to say the least."
