Rep. McIver faces serious assault charges for alleged physical actions against ICE officers
Rep. LaMonica McIver (D-NJ), who nobody really knew until she allegedly assaulted an Immigration and Customs Enforcement (ICE) officer during a silly protest, is in potentially deep legal trouble.
According to The Hill, in a criminal complaint filed by the Department of Justice, McIver was accused of having "'slammed her forearms" into an ICE agent as other officers attempted to arrest the mayor of Newark, New Jersey.
McIver faces the possibility of felony-level assault charges as the case develops and new evidence emerges showing her aggressive actions from that day.
The criminal complaint against the Democratic lawmaker was made public on Tuesday, and has provided the clearest picture so far as to how far over the line McIver went during a protest at an ICE detention center.
What's going on?
According to court filings, McIver is facing serious criminal charges for her actions on that day.
The Hill noted:
McIver is charged with two counts of assaulting federal employees engaged in their official duties, one corresponding to an ICE officer and the other a Homeland Security Investigations (HSI) agent. If convicted, the charge can carry up to eight years in prison.
The criminal complaint released to the public on Tuesday shows several still images apparently showing McIver aggressively using her forearms while getting physical during the attempted arrest.
The document detailed what allegedly happened during the confrontation.
“After numerous warnings to leave, and numerous warnings of potential arrest, the HSI agent announced he was going to place the Mayor under arrest. McIVER interjected, yelling ‘Hell no! Hell no! Hell no!’" the document read.
It added, "The HSI agent ordered the Mayor to put his hands behind his back and displayed his handcuffs. McIVER and other members of Congress surrounded the Mayor and prevented HSI from handcuffing him and taking him into custody."
"Human shield"
The document detailed the lawmaker's attempts to form a "human shield" around the Newark mayor during the attempted arrest.
"At that time, McIVER hurried outside towards the agents and attempted to thwart the arrest as others yelled 'circle the Mayor,'" it read.
“McIVER faced the Mayor and placed her arms around him. She and others encircled him in a ‘human shield’ effort to prevent HSI from completing the arrest that was initiated in the secured area."
While her first court appearance isn't on the docket yet, many believe it won't be long before she has to answer for her alleged actions.
