RFK Jr. asks Supreme Court to put his name back on New York state ballot

Robert F. Kennedy Jr. caused a political upheaval in August when he suspended his independent presidential campaign and endorsed former President Donald Trump.

Yet while Kennedy has sought to remove his name from swing state ballots, he is now asking the Supreme Court to restore it in New York. 

State judge called Kennedy's address a "sham"

According to CBS News, Kennedy filed an emergency appeal with America's highest judicial body earlier this week after lower courts ruled against him.

In it he argued that New Yorkers "have a constitutional right to have Kennedy placed on the ballot — and to vote for him, whether he is campaigning for their vote or not."

USA Today noted how trial Judge Christina Ryba found late last month that Kennedy had falsely listed an address in Katonah, New York as his primary residence.

Ryba maintained in her decision that there was "clear and convincing credible evidence" showing the candidate's actual home is the house he owns in California.

Kennedy denies that "anyone was misled by the address"

She asserted that the Katonah address "was not Kennedy's bona fide and legitimate residence, but merely a 'sham' address that he assumed for the purpose of maintaining his voter registration and furthering his own political aspirations in this State."

In his brief, Kennedy's lawyers countered that Ryba "did not find that anyone was misled by the address, nor identify any state interests compromised by its use."

They also took issue with the suggestion that he is no longer running for office, since "a suspended campaign is not a terminated campaign."

"Whether suspending a campaign or only appearing on ballots for some states is a prudent political strategy is irrelevant to the legal issues in this case," the brief read.

Michigan officials reject request to delist Kennedy

"The prudence of such a strategy will be debated by an array of political pundits, a flock of history and political science professors, and a chattering of voices on social media," it added.

Meanwhile, Kennedy has had difficulties in getting his name taken off the ballot in hotly contested states, with WKAR reporting that he failed to so in Michigan where he was nominated by the Natural Law Party.

"Robert F. Kennedy Jr.'s campaign reached out to the Michigan Bureau of Elections late this afternoon in an attempt to withdraw his name," WKAR  quoted bureau spokesperson Cheri Hardmon as saying on August 23.

"The Natural Law Party held their convention to select electors for Robert Kennedy Jr. They cannot meet at this point to select new electors since it's past the primary," she added.
