Supreme Court agrees to review law that would shut down TikTok in America

January 10, 2025, could be a huge day in American history for fans of social media apps.

America's Supreme Court is reviewing a law that could potentially ban TikTok if it is not overturned before January 19, 2025.

Although it's still VERY early in the process, early reports indicate that the judges might be likely to UPHOLD the law that could result in TikTok being banned in the United States.

The Case

TikTok is owned by ByteDance, a Chinese company with ties to the CCP. As a result, many lawmakers in America don't want ByteDance to have almost complete access to the data of millions and millions of Americans.

Congress recently came up with a deadline of January 19, 2025, for ByteDance to either completely divest from TikTok or have the app banned in America.

While it seems obvious that something should be done to prevent the Chinese government from having such easy access to our data, there are two sides to every story.

TikTok, ByteDance, content creators, and Donald Trump are all saying that the law demanding the app be sold or face banishment is unprecedented in American history. Those in favor of the app are saying that a total ban would be a violation of free-speech protections and are asking the Supreme Court to block the law.

According to The Washington Post, proponents of the app say that "shuttering the platform would violate their First Amendment rights to share, view and engage with short video clips about politics, music, cooking, the arts and more."

The justices were tasked with weighing those claims against any and all threats to national security. People who want TikTok banned say that "TikTok, which has more than 170 million users in the United States, could be pressured by the Chinese government to covertly manipulate public opinion in the United States or to provide access to Americans’ data."

Supreme Court decides

According to APNews.com, at the time of writing, the Supreme Court seemed likely to uphold the law that could lead to TikTok being banned in America.

Currently, the law passed by Congress and signed by President Joe Biden will require TikTok to "go dark" on January 19, 2025. That does NOT sit well with TikTok lawyer Noel Francisco.

According to the AP:

At the very least, Francisco urged, the justices should enter a temporary pause that would allow TikTok to keep operating. “We might be in a different world again” after President-elect Donald Trump takes office on Jan. 20. Trump, who has 14.7 million followers on TikTok, also has called for the deadline to be pushed back to give him time to negotiate a “political resolution.” Francisco served as Trump’s solicitor general in his first presidential term.
