Texas AG looks to put a stop to Biden's southern border policy

Texas Attorney General Ken Paxton (R) has asked the courts for a restraining order stopping President Joe Biden from implementing a southern border policy that would allow illegal immigrants to be paroled into the United States without court dates.

The lawsuit comes as Title 42 - the Trump-era policy used to expel illegal immigrants from the United States during the COVID-19 pandemic - has come to an end and as illegal immigration at the southern border is surging. This past week alone, U.S. Customs and Border Patrol (CBP) had over 10,000 migrant encounters on three separate days.

Biden is attempting to address the crisis with several policies of his own.

The policy

One of the policies that Biden is looking to implement would address the situation of overcrowding. The policy was revealed in a memo - from the U.S. Department of Homeland Security (DHS) - that was released on Wednesday.

Fox News reports: "The policy authorizes parole if a sector capacity goes above 125%, if agents apprehend 7,000 a day over 72 hours, or if average time in custody goes above 60 hours."

Here it is worth reiterating that CBP had three days of more than 10,000 illegal immigrant encounters in the past week alone.

So, what is meant by "the policy authorizes parole"?

According to Fox, migrants would be released "without a court date and without an alien registration number." And, they would be asked "to make an appointment with Immigration and Customs Enforcement (ICE) or request a Notice to Appear in court by mail."

The lawsuit

Paxton, and several other attorneys general from other states, are now teaming up to challenge this policy in court. Right off the bat, they are seeking a restraining order stopping the Biden administration from implementing this policy.

Paxton has released a statement in conjunction with the lawsuit.

Paxton says:

As the number of daily border crossings hits record highs and Title 42 expires, the Biden Administration has announced they will release thousands of illegal immigrants every day - without even requiring a court date. To any reasonable American, this is insanity.

It remains to be seen whether the court will grant the requested restraining order.

Paxton, in his statement, also said this:

There are no words that can fully describe the unmitigated catastrophe that Joe Biden has created on our southern border. What we are watching in real time is the systematic, deliberate, and intentional destruction of American border security. There’s simply no other explanation for what Biden is doing.
