Trump accuses Biden, Jack Smith of staging 'show trial' in recusal motion

Donald Trump's lawyers accused Joe Biden of trying to "take out" his political rival in a heated court filing Sunday.

Trump's lawyers are seeking the recusal of the judge overseeing Trump's federal case for "overturning" the 2020 election, Tanya Chutkan, citing her biased comments.

They note that Chutkan, in a previous case, wondered aloud why Trump had not been charged yet over January 6th.

"People who mobbed that Capitol were there in fealty, in loyalty, to one man — not to the Constitution,” she said.

Biden's show trial

Prosecutor Jack Smith has argued Chutkan's comments are somehow being taken out of context, but Trump's team called them "gratuitous" and plainly hostile toward Trump.

His lawyers even called the proceeding a "show trial" orchestrated by Biden to undermine his chief political opponent, a claim Trump has levied many times in public.

Smith's trial is a "politically motivated effort by the incumbent administration to take out its most significant political opponent in a presidential campaign — the opponent who, by the way, is not only free, but has a strong lead in the polls," Trump's lawyers argued.

In another case, Chutkan seemingly compared Trump to an aspiring tyrant, writing, "Presidents are not Kings." Trump's lawyers threw Chutkan's words back at her.

"No president is a king, but every president is a United States citizen entitled to the protections and rights guaranteed by the United States Constitution."

Silencing the opposition

Democrats insist there is nothing political about four indictments being filed at the same time by Democratic prosecutors against Trump, the chief rival of the Democratic party.

Smith requested a gag order Friday, citing Trump's comments attacking the case as a political sham.

Smith fretted that Trump could potentially influence the jury pool in Washington D.C., where 92 percent of voters chose Joe Biden in 2020.

"Through his statements, the defendant threatens to undermine the integrity of these proceedings and prejudice the jury pool," Smith complained.

Chutkan has yet to weigh on the gag order request, but it seems doubtful she will bend over backward to respect Trump's rights.

“So, I’m campaigning for President against an incompetent person who has WEAPONIZED the DOJ & FBI to go after his Political Opponent, & I am not allowed to COMMENT?" Trump wrote in response to the gag order request. "They Leak, Lie, & Sue, & they won’t allow me to SPEAK? How else would I explain that Jack Smith is DERANGED, or Crooked Joe is INCOMPETENT?”

" A free people [claim] their rights, as derived from the laws of nature."
