Trump admin. petitions Supreme Court to allow swift deportation flights

President Donald Trump and his administration petitioned the Supreme Court on Friday to allow it to carry out swift deportations via the Alien Enemies Act; this would overturn an injunction by the lower court barring him from flying illegal immigrants back to their countries of origin or to detention facilities abroad. 

It is the first time the Trump administration has asked the Supreme Court to get involved in a case since Trump took office in January, despite the fact that those on the left are slapping the administration with lawsuits every chance they get.

“This case presents fundamental questions about who decides how to conduct sensitive national-security-related operations in this country—the President, through Article II, or the Judiciary, through TROs,” acting Solicitor General Sarah Harris wrote.

“The Constitution supplies a clear answer: the President. The republic cannot afford a different choice,” she continued.

An invasion

Trump has said that the Venezuelan Tren de Aragua gang has effectively "invaded" the country and that the act can therefore be used to summarily deport Venezuelans at the president's discretion.

The 1798 act has only been used three other times in U.S. history, and those times were during actual wars.

U.S. District Judge James Boasberg issued a temporary restraining order (TRO) blocking deportation flights just as the administration was flying hundreds of migrants suspected of being gang members to a prison in El Salvador.

The flights landed anyway, and Trump said Boasberg didn't have the authority to stop them. An appeals court declined 2-1 to lift the injunction last week.

Now, Trump is asking the court to affirm his view so that flights can continue.

Lawfare in overdrive

The use of lawfare to stymie Trump's plans and policies has gone beyond anything the country has ever seen.

It is true that Trump is also going beyond what many other presidents have done as he tries to fix the damage inflicted by the Biden administration.

This is likely making judges who oppose him feel justified in ruling against his moves.

If Trump can't find a way around these frequent court rulings, he won't be able to undo what Biden did to harm the country.

His agenda is already in jeopardy, and there's a long way to go in making things right.
