Trump appeals unfavorable court rulings in hush money case, RICO suit against Clinton
Former President Donald Trump is not taking no for an answer, filing appeals this week in two different cases--one against him and one he filed against Hillary Clinton and others who tried to go after him in 2016.
Trump lawyers filed a motion on Friday that he will appeal the ruling that said there was no reason to move the Manhattan hush money case against him to federal court.
Trump denied
US District Judge Alvin Hellerstein denied Trump’s request to do so earlier this month saying his alleged criminal conduct was unrelated to his role as president.
Hellerstein wrote, “The evidence overwhelmingly suggests that the matter was purely a personal item of the President – a cover-up of an embarrassing event. Hush money paid to an adult film star is not related to a President’s official acts.”
“Whatever the standard, and whether it is high or low, Trump fails to satisfy it,” she concluded.
Obviously, Trump has a much better chance of getting a favorable jury if the case goes federal--he appointed a large number of the federal judges now sitting on the bench.
He's facing 34 counts of falsifying business records, which is normally a misdemeanor and would be beyond the 5-year statute of limitations, but somehow has become a felony that is not beyond the statute of limitations.
RICO reversal
Trump's second appeal is the dismissal of a RICO (racketeering) case he brought against Hillary Clinton, members of her campaign, the Democrat National Committee, and some government officials who he says conspired to bring false accusations against him.
The actual case is already being appealed after Judge Donald Middlebrooks dismissed the case and attempted to sanction Trump's lawyers for even bringing it, but he is now trying to get an indicative ruling based on the new evidence he said was provided by the John Durham report.
The Durham report “corroborates facts that are key to the plausibility and probability” of Trump's claims in the case, his lawyers said.
“Therefore, the introduction of this evidence is likely to change the outcome of this case at every level of the proceedings,” the filing said.
Meanwhile, Democrats and some Republicans are doing everything they can to bring him down before the election.
