Trump files amicus brief with SCOTUS in multi-state effort to stop Biden from selling border wall materials
President-elect Donald Trump isn't wasting any time setting up his border wall and immigration policies, and he's starting by going to the U.S. Supreme Court to stop the Biden administration from selling border wall materials.
According to Fox News, the president-elect joined the states of Texas and Missouri in requesting that President Joe Biden and his administration not continue to sell additional border wall materials.
The administration came under fire from many on the right after it was revealed that they had listed massive quantities of border wall construction materials on government auction sites for "pennies on the dollar."
Trump and his lawyers filed an amicus brief with both states with the high court, adding that he believes the sale of the border wall materials could be "criminal."
What's going on?
Earlier in the week, both states filed a motion in the district court in the southern district of Texas "to hold a status conference to determine if the government is in breach of the court’s permanent injunction from earlier this year."
The injunction was meant to ban the Biden administration from using allocated border wall funds for anything other than the construction of the border wall.

Trump held nothing back in his amicus brief filed with the conservative-dominated Supreme Court.
"The Court should issue an order directing the Defendants to immediately stop any ongoing sale of border-barrier materials to private parties pending the Court’s review of Defendant’s conduct, and the Court should swiftly conduct a searching examination of the Government’s conduct, by formal discovery if necessary, to examine the Government’s compliance with the law, the Constitution, and the Court’s injunction," Trump wrote.
Reportedly, the Biden administration has been engaged in auctioning off border wall construction materials since 2023.
"Major financial loss"
In his brief, Trump claimed that the Biden administration is "deliberately selling off border-wall materials at a major financial loss to the Government to obstruct the pro-wall policy of Congress and President Trump, such conduct likely constitutes a criminal act, such as a conspiracy to defraud the United States."
The brief added, "At the very least, the reported conduct raises troubling concerns of potentially criminal behavior."
Some Republican lawmakers and senators have also called for possible criminal charges for those behind the auctioning of the border wall materials.
Only time will tell if the Supreme Court intervenes.
