Trump admin asks SCOTUS to lift injunction on deportations of criminal illegal aliens to third-party nations
Numerous aspects of President Donald Trump's policy agenda have been blocked from implementation by left-leaning federal judges, particularly his efforts to rapidly deport criminal illegal aliens out of the U.S.
On Tuesday, the Trump administration urged the Supreme Court to intervene and lift an injunction imposed by a Massachusetts judge that ostensibly bars the deportation of illegal aliens to third-party nations, Fox News reported.
The district judge, a Biden appointee, ruled last month that the administration could not proceed with deporting illegal aliens to countries that were not their own unless they were first provided with "meaningful" advance notice and an opportunity to challenge their removal from the U.S in court.
Judge blocks deportations to third-party countries
According to SCOTUSblog, the Trump administration and U.S. District Judge Brian Murphy have clashed multiple times since March, when the judge first ordered a halt to deportations of illegal aliens to third-party nations they did not originally hail from.
That included blocking an effort to deport eight convicted criminal illegal aliens to South Sudan, with those criminal aliens now being held in limbo in ICE custody at a U.S. military base in the nearby East African nation of Djibouti.
The judge ruled that those illegal aliens, despite being convicted of violent crimes in the U.S. and already having removal orders filed against them, deserved at least 10 days of notice about their third-party nation destination and an opportunity to further challenge their ordered deportations, particularly if they believe they may face persecution or torture in the third-party country.
Trump admin files emergency request for stay of injunction
In an emergency request filed on Tuesday, SCOTUSblog reported that U.S. Solicitor General John Sauer urged the Supreme Court to swiftly intervene to lift Murphy's injunction and allow the planned deportations to happen while the underlying legal challenge proceeds on the merits.
Sauer asserted that the "judicially created procedures" from judges like Murphy are "currently wreaking havoc on the third-party removal process," causing disruptions to "sensitive diplomatic, foreign-policy, and national-security efforts," and infringing upon the executive branch's authority over immigration laws.
He further argued that an intervention was necessary to address the lower court's interference in "the government’s ability to remove some of the worst of the worst illegal aliens."
"Convincing third countries to accept some of the most undesirable aliens requires sensitive diplomacy, which involves negotiation and the balancing of other foreign-policy interests," Sauer noted. And, "Until recently," he added, "those efforts were working" -- that is, until Murphy's order "stalled these efforts nationwide."
The solicitor general concluded that an administrative stay of the district court's injunction, which would allow deportations to continue while the case proceeds, was warranted because of "the urgency of the circumstances and the government’s ongoing irreparable injury in the diplomatic, immigration, and foreign policy spheres."
Trump called out interference by "out of control" judges
It was just last week that President Trump wrote in a Truth Social post that the Boston-based Judge Murphy, "who knew absolutely nothing about the situation, or anything else, has ordered that EIGHT of the most violent criminals on Earth curtail their journey to South Sudan, and instead remain in Djibouti. He would not allow these monsters to proceed to their final destination."
"This is not the premise under which I was elected President, which was to PROTECT our Nation," he continued. "The Judges are absolutely out of control, they’re hurting our Country, and they know nothing about particular situations, or what they are doing -- And this must change, IMMEDIATELY! Hopefully, the Supreme Court of the United States will put an END to the quagmire that has been caused by the Radical Left."
"If this is not worked out quickly, and the World is watching, our Country will be under siege again, with hundreds of thousands of hardened criminals, 'BREAKING DOWN THE WALLS," Trump added. "We were also forced to leave behind, in order to watch these hardened thugs, a large number of ICE Officers, who would otherwise be in the United States, protecting our Citizens."
