Trump will not attend Supreme Court hearing on tariff case

America's highest judicial body is set to hear arguments this week over the extent of President Donald Trump's authority to impose tariffs.

Although the case has major implications for the president's agenda, Trump has made clear that he will skip the hearing. 

Trump: "I will not be going to the Court on Wednesday"

According to The Hill, Trump's announcement came in the form of a post he made to his Truth Social platform this past weekend.

"I will not be going to the Court on Wednesday in that I do not want to distract from the importance of this Decision," the president wrote.

"It will be, in my opinion, one of the most important and consequential Decisions ever made by the United States Supreme Court," Trump predicted.

"If we win, we will be the Richest, Most Secure Country anywhere in the World, BY FAR. If we lose, our Country could be reduced to almost Third World status — Pray to God that that doesn’t happen!" he went on to add.

Case concerns 1977 law

At issue is the extent of Trump's freedom under the International Emergency Economic Powers Act (IEEPA), a piece of legislation which was signed into law by President Jimmy Carter.

The law permits a president to regulate commercial interactions between the United States and other nations after a state of emergency has been declared.

While Trump has maintained that the law allows him to correct America's trade imbalance, a three-judge panel at the New York-based Court of International Trade (CIT) found in May that his tariffs "exceed any authority granted to" him.

Fox News reported that the U.S. Court of Appeals for the Federal Circuit later agreed with that assessment in a September ruling.

"We affirm the CIT’s holding that the Trafficking and Reciprocal Tariffs imposed by the Challenged Executive Orders exceed the authority delegated to the President by IEEPA’s text," it asserted.

Trump says loss of tariffs would be "a total disaster"

The network noted how that ruling brought condemnation from Trump in a Truth Social post, stating, "Today a Highly Partisan Appeals Court incorrectly said that our Tariffs should be removed, but they know the United States of America will win in the end."

"If these Tariffs ever went away, it would be a total disaster for the Country. It would make us financially weak, and we have to be strong," he asserted.

"The U.S.A. will no longer tolerate enormous Trade Deficits and unfair Tariffs and Non Tariff Trade Barriers imposed by other Countries, friend or foe, that undermine our Manufacturers, Farmers, and everyone else," Trump pledged.
