Trump's USDA freezes Maine funding over state's transgender sports stance

President Donald Trump and Democrat Maine Gov. Janet Mills got into a spat in February over her state's refusal to comply with a federal prohibition against allowing biological males to compete with and against biological females in school sports.

On Wednesday, Trump, through the U.S. Department of Agriculture, made good on his vow to freeze some federal funding to Maine until the state is in full compliance with applicable federal anti-discrimination laws, Breitbart reported.

Meanwhile, the departments of Education, Health and Human Services, and Justice have all launched investigations into Maine's noncompliance and have all suggested that the state could lose additional federal funding if it continues to refuse to abide by the rules against allowing transgender women and girls to participate in athletics with biological women and girls.

Maine defies Trump order, federal law

On Feb. 5, President Trump signed an executive order on "Keeping Men Out of Women's Sports" and declared that, pursuant to the requirements of Title IX of the Education Amendments Act of 1972, "it is the policy of the United States to rescind all funds from educational programs that deprive women and girls of fair athletic opportunities, which results in the endangerment, humiliation, and silencing of women and girls and deprives them of privacy."

Just a couple of weeks later, during a White House event with many of the nation's governors, Trump called out Gov. Mills for her state's noncompliance with the order and Title IX's stipulations, and vowed at that time, "You better comply, or you’re not getting any federal funding."

"See you in court," Mills replied, to which Trump retorted, "Good. See you in court, that should be a real easy one. Enjoy your life after, governor, I don’t think you’ll be in elected office."

Funds frozen, reviews launched

Fast-forward a month and, after multiple opportunities for Maine to address the issue, USDA Sec. Brooke Rollins sent a letter to Gov. Mills to inform her of the consequences of her state's blatant and continued noncompliance with federal law.

"You cannot openly violate federal law against discrimination in education and expect federal funding to continue unabated," Rollins wrote. "Your defiance of federal law has cost your state, which is bound by Title IX in educational programming."

"Today, I am freezing Maine's federal funds for certain administrative and technological functions in schools," she continued. "This is only the beginning, though you are free to end it at any time by protecting women and girls in compliance with federal law."

"In order to continue to receive taxpayer dollars from USDA, the state of Maine must demonstrate compliance with Title IX's protection of female student athletes from having to compete with or against or having to appear unclothed before males," the secretary revealed.

"USDA, alongside other federal agencies, will continue to pause and, where appropriate, terminate categories of education programming in Maine if these Title IX violations are not resolved to the satisfaction of the Federal Government," Rollins added. "This pause does not impact federal feeding programs or direct assistance to Mainers; if a child was fed today, they will be fed tomorrow."

More action possible from DOE, HHS, DOJ

In addition to the freeze of certain federal funds for Maine, Sec. Rollins' letter to Gov. Mills also announced that a thorough review had been launched by the USDA into "all research and education-related funding" in Maine, as well as of all grants issued by the Biden-Harris administration, many of which "appear to be wasteful, redundant, or otherwise against the priorities of the Trump Administration" and will not be extended.

At the same time, Breitbart reported, both the Departments of Education plus Health and Human Services have conducted investigations that determined that Maine violates Title IX because of its transgender inclusion policies.

Should Maine and Gov. Mills continue to defy federal law and the president's order, the state could find out that even more federal funds from those departments have been frozen or rescinded, if not also that they're on the receiving end of a Justice Department probe and civil enforcement lawsuit.
