White House asks that Supreme Court stop judge from blocking cut to DEI grants

Earlier this month, a Biden-appointed federal judge blocked an order to end funding for two Department of Education grant programs.

However, the Trump administration has responded by requesting that the Supreme Court lift his nationwide injunction.  

Case concerns controversial teacher training grants

According to Fox News, U.S. District Judge Myong Joun is presiding over a lawsuit which was filed by California and seven other states.

They are fight to save approximately $600 million worth of grants which are distributed through the Teacher Quality Partnership (TQP) and Supporting Effective Educator Development (SEED) programs.

Fox News noted how the Department of Education maintains that the grants in question are used to promote "divisive ideologies."

This includes paying for diversity, equity, and inclusion (DEI) programs which feature "instruction on white privilege and white supremacy."

Solicitor general warns that judges are "exceeding their jurisdiction"

Acting Solicitor General of the United States Sarah M. Harris submitted a filing this past Wednesday arguing that the "case exemplifies a flood of recent suits that raise the question."

"Does a single district-court judge who likely lacks jurisdiction have the unchecked power to compel the Government of the United States to pay out (and probably lose forever) millions in taxpayer dollars?" Harris asked.

"Unless and until this court addresses that question, federal district courts will continue exceeding their jurisdiction by ordering the executive branch to restore lawfully terminated grants across the government, keep paying for programs that the executive branch views as inconsistent with the interests of the United States, and send out the door taxpayer money that may never be clawed back," she warned.

"This court should put a swift end to federal district courts’ unconstitutional reign as self-appointed managers of executive branch funding and grant-disbursement decisions," Harris added.

White House asks that immigration-related injunctions be reversed

This is not the only issue on which the Trump administration has sought to limit the power of district court judges, as it has also done so regarding immigration.

As Breitbart reported, Harris recently asked America's highest judicial body to reverse "flawed orders" issued by U.S. District Judge James Boasberg which prevent the president from using the Alien Enemies Act to remove gang members.

"At a minimum, the Acting Solicitor General respectfully requests that this Court grant an administrative stay while it considers the government’s submission," Harris wrote in her filing.
