Muse lead singer Matthew Bellamy has filed for divorce from model Elle Evans after six years of marriage, asking a Los Angeles court to grant him full legal and physical custody of their two young children.

Bellamy filed the petition on Aug. 12, citing irreconcilable differences and invoking the couple's premarital agreement on financial matters, Fox News Digital reported after obtaining the court documents. The filing did not list a date of separation, and the specific terms of the prenup, including any dollar figures, were kept out of the public record.

The custody request stands out. Bellamy is not asking for shared parenting time or a joint arrangement. He wants both legal custody, which governs major decisions about the children's upbringing, and physical custody, which determines where they live day to day. The couple shares a daughter born in 2020 and a son born in 2024.

Bellamy says 'unexpected circumstances' forced him to put his children first

Bellamy had already revealed the breakup before the court filing landed. In a June interview with The i Paper, the British rocker said the couple separated "last summer" under conditions he described as unusual.

"Because it's one of those situations that involves something that people wouldn't normally think it is. It was a set of really unexpected circumstances."

He did not elaborate on what those circumstances were. But he framed the fallout in terms of his children's welfare, telling the same outlet that the split left him reordering his priorities.

"It's the kind of thing no one really prepares for in life. It threw me off, and I had to prioritize [looking after the kids] and creating stability at home."

That language tracks with the divorce petition itself. Bellamy's decision to seek sole custody, rather than the more common joint arrangement seen in California family courts, suggests he views himself as the parent better positioned to provide that stability. Evans has not made any public statement in response to the filing.

Prenup invoked, but financial picture remains incomplete

He flagged the possibility of additional community property and debts still to be sorted out and reserved the right to amend the petition as that picture becomes clearer.
