Former FBI task force leaders charged with lying to Congress over Hunter Biden laptop probe

Two former senior FBI officials who led the bureau’s Foreign Influence Task Force have been charged with lying to Congress about Hunter Biden investigations, a case their lawyers call political and prosecutors say restores basic accountability.

The Department of Justice charged Nikki Cole Floris and Bradley Benavides with lying to lawmakers about their roles in FBI work tied to Hunter Biden and his laptop. Both surrendered Friday on arrest warrants, Fox News reported.

Floris, 46, had served as deputy assistant director and functional head of the Foreign Influence Task Force. Benavides, 56, was a section chief on the same unit. The task force has since been dissolved. Each faces one count of lying to Congress and up to five years if convicted.

U.S. Attorney Jeanine Pirro framed the case as a direct challenge to the idea that senior agents can mislead Congress without consequence.

"Lying to Congress by anyone strikes at the heart of our democratic system, but when senior FBI agents lie to Congress believing they are above the law, it’s time to bring the hammer of justice down on them."

Pirro added that senior officials who choose deception over duty undermine the institutions they swore to protect, and that no one is above the law.

Testimony collided with email logs and internal messages

A Justice Department statement of facts points to Floris’s 2023 testimony before the House Judiciary Committee. She denied any involvement in the Hunter Biden investigation and said there was never a discussion at the task force about him.

Prosecutors say email logs show she discussed Hunter Biden with bureau colleagues. The New York Post reported that internal messages and emails show both officials discussed the laptop frequently before the 2020 election and helped shape FBI responses to press inquiries after the New York Post’s original laptop story. Benavides circulated a framing that treated the laptop as a Russian disinformation effort. Floris replied, “Looks good!” Both had been part of an informal “Round River” group that compiled derogatory information on Hunter Biden.

In a July 19, 2023, transcribed House Judiciary interview, Floris answered questions about the laptop with “I did not” and “I don’t have any knowledge of said laptop.”

Benavides told lawmakers he learned there was an ongoing criminal investigation related to the laptop by reading the Wikipedia page. The Justice Department says emails show he was in contact with the team working the Hunter Biden investigation, met with that team before a meeting with lawmakers, and discussed the laptop story with others inside the FBI.

National Review reported that prosecutors allege the statements were made to conceal the task force’s engagement with and communications about the Hunter Biden investigations.

Patel ties arrests to 2020 election matters

FBI Director Kash Patel said the bureau arrested the two former task force members over alleged lies to Congress in 2023 on matters regarding investigations related to the 2020 election.

"This morning the FBI arrested two former FBI members of the now dissolved Foreign Influence Task Force, Nikki Floris and Bradley Benavides, both of whom allegedly lied to Congress in 2023 on matters regarding investigations related to the 2020 election."

Patel said one of the individuals is on record privately claiming to be “running a shadow government” during the 2020 election, and that weaponization will never be tolerated at this FBI. The Washington Examiner reported that Patel cited documentary evidence, contemporaneous communications, and witness accounts that contradict their July and September 2023 testimony that the task force was not involved.

Republican Sens. Chuck Grassley and Ron Johnson had previously accused Floris and Benavides of taking part in a 2020 FBI briefing about Russian disinformation that the senators said was meant to undercut their inquiry into Hunter Biden’s foreign business dealings. Claims that the laptop was Russian disinformation fueled intense controversy ahead of the 2020 election. The FBI later authenticated the laptop during Hunter Biden’s 2024 federal gun trial, when prosecutors introduced it as evidence. Defense calls the charges baseless and timed for politics

Attorneys for Floris rejected the case in strong terms.

"Nikki Floris is a patriot. She served our nation as a dedicated FBI intelligence officer for nearly 20 years. Yet today, the DOJ has accused her falsely of a crime on the say-so of politicians, not on the facts. It’s no coincidence the government is filing these nonsense charges now, years later, on the eve of an election."

Benavides’s lawyer said he spent 20 years protecting the public from terrorists and foreign agents and called the complaint transparently political.

"For 20 years Brad Benavides worked tirelessly to protect the public from terrorists and agents of foreign governments. He carried with distinction the heavy burden of thwarting terrorist plots to kill Americans and other innocents. Brad protected our democracy against those who would destroy it."

The same lawyer called the charges “a disgrace” and said the truth will come out in court: that Benavides is a patriot who devoted his career to protecting the country. Coverage of other FBI scrutiny, including a Virginia Democrat’s claim that the FBI monitored his calls, has kept public attention on how the bureau uses its power.

Pirro’s office and Patel’s FBI present the case as straightforward accountability for false statements under oath. The defense presents it as delayed, selective, and driven by politics rather than evidence. The charging papers and the 2023 transcripts will now be tested in court.

Hunter Biden’s own public profile has remained turbulent, from legal battles to political talk of a possible 2028 White House bid and even short-lived online ventures such as a laptop-themed meme coin that crashed within an hour. Separate debates over whether future administrations will revisit past Biden-era investigations continue, including warnings about reciprocal probes if partisan impeachment fights return.

For years, voters watched the laptop story bounce between “disinformation” briefings, suppressed reporting, and eventual courtroom authentication. Charging former task force leaders for alleged lies to Congress puts the question of who knew what, and who said what under oath, where it belongs: in open court, with evidence on the table and no special exemptions for the people who once ran the room.
