Misdemeanor criminal charge still stands against Gold Star father who disrupted Biden's State of the Union address

A Gold Star father whose U.S. Marine son was killed by a suicide bomber outside the Kabul airport during the disastrous U.S. withdrawal from Afghanistan was arrested and criminally charged after he disrupted and heckled President Joe Biden during last week's State of the Union address.

That still-grieving parent, Steven Nikoui, father of the late Marine Lance Cpl. Kareem Nikoui, revealed this week that the charges pressed against him have still not been dropped despite outraged demands for such from elected Republicans and the general public, according to the New York Post.

Nikoui, who has been adamant that Biden, among others, is "100%" responsible for his son's untimely death in August 2021, shouted out "Remember Abbey Gate," the location of the fatal bombing, as well as his deceased son's name, rank, and unit during the president's address, which led to his immediate removal from the gallery and subsequent booking on a misdemeanor charge of crowding, obstructing, or incommoding Congress.

Criminal charge has not yet been dropped

In an interview this week with the Daily Mail, Nikoui said the criminal charge against him has not yet been dropped and that he has heard "nothing" yet from the U.S. Capitol Police, despite the pressure campaign from elected officials and others for police and federal prosecutors to drop the charge.

"I was just strongly convicted by the Holy Spirit to stand up and say that after sitting there for almost an hour of just total disrespect to us," Nikoui said of his outburst against President Biden. "He knew that there were other Gold Star family members, he could of at least just said their names and this would have been done."

He revealed that he found it particularly "devastating" that Biden had mentioned by name Georgia nursing student Laken Riley, who was murdered by an illegal immigrant, but has never taken the time to publicly state the names of the 13 U.S. service members killed in the Kabul airport suicide bombing.

"I've waited three years, I paid $3,000 ... and I've traveled 3,000 miles just to finally hear my son's name in the State of the Union," Nikoui said and noted that other Gold Star families have faced a similar problem. "We've all spent thousands of dollars, that trip to the State of the Union -- what a kick in my ass. That cost me three grand, hotels are really expensive. And then getting thrown into jail."

He went on to say that "Joe Biden, personally, is the reason for that fiasco, 100%," as are former top military officials at the time of the botched Afghanistan withdrawal, who in his view "should have been bold and taking a stand and resign. Maybe it would have changed the course of history."

Earlier in the week, Nikoui also spoke about the State of the Union address during an interview with Fox News host Sean Hannity, and explained, "I was looking at this spectacle that I was seeing below me, and I was listening to him, and I was praying, hoping that maybe at some point prior to this that he had mentioned Afghanistan [and] our kids, because all the Gold Star parents were thinking that that might be a possibility, and it wasn't happening."

"And then as soon as he said something about kids and then something about being safe -- I don't even know what I did," he continued. "I just jumped up, and I said, 'Do you remember Abbey Gate?' -- It was like the Lord convicted me. The Holy Spirit got in me, and when I did it, I paused. I was like, 'Oh, what did I do?'"

The Gold Star father went on to note that he disrupted President Biden's speech "because I've been waiting three years for this man to say my son's name in this chamber -- and he never did. But on this day -- on this day -- his name was said."

Congressman decries "BS charge" against Gold Star father

The Post reported that Nikoui had been invited to the annual presidential address to Congress as a guest of Rep. Brian Mast (R-FL), a former combat veteran, who also reportedly helped arrange for Nikoui's release from custody following the arrest for disrupting and heckling the president.

"Mr. Nikoui lost his son due to Joe Biden’s incompetence, and lost another son to grief over his brother being killed," Mast told the Post, referencing the 2022 suicide of Dakota Halverson, a non-blood relative of the slain service member. "This man and his family have given America more than I could personally bear and to attack him with a BS charge of 'demonstrating' is a disgrace."

Unless the misdemeanor charge against Nikoui is dropped between now and then, he is due to appear in a Washington D.C. courtroom for a hearing on March 28.
