Federal judge block New Mexico governor's ban on carrying firearms

New Mexico Democratic Gov. Michelle Lujan Grisham provoked outrage last week when she banned the carrying of guns in Albuquerque for 30 days.

Yet according to Breitbart, a federal judge just issued a temporary restraining order on blocking the rule. 

Public agencies stopped from enforcing ban

U.S. District Judge David Herrera Urias released his decision on Wednesday, writing,

IT IS THEREFORE ORDERED BY THE COURT that the Defendants New Mexico Governor Michelle Lujan Grisham, New Mexico Department Secretary Patrick M. Allen, New Mexico Department of Public Safety Jason R. Bowie, Chief of the New Mexico State Police and any other New Mexico officials (“Defendants”) are ENJOINED from applying, enforcing, or attempting to enforce, either criminally or civilly, Section (1) of the New Mexico Department of Health’s “Public Health Emergency Order Imposing Temporary Firearm Restrictions, Drug Monitoring and Other Public Safety Measures” (“PHO”) published on September 8, 2023.

Urias added that his order will remain in effect "until such time as the Court has ruled on the Plaintiffs’ motions for preliminary injunction, following a hearing at which all parties shall have the opportunity to present further argument to this Court."

That action came in response to a lawsuit filed by multiple pro-gun groups, including Gun Owners of America, the National Association for Gun Rights, the New Mexico Shooting Sports Foundation, and the Gun Owners Foundation.

Even some Democrats object

Lujan Grisham's announcement that her prohibition would even extend to those with valid concealed handgun permits was met with scorn from critics, with conservative activist Benny Johnson calling her "tyrannical."

However, condemnation for Lujan Grisham's actions didn't just come from conservatives, as even some on the left took issue as well.

They included California Democratic Rep. Ted Lieu, who tweeted, "I support gun safety laws. However, this order from the Governor of New Mexico violates the U.S. Constitution."

Ted Cruz shocked that he agrees with Ted Lieu

"No state in the union can suspend the federal Constitution. There is no such thing as a state public health emergency exception to the U.S. Constitution," he insisted.

That led to a shock response from Texas Republican Sen. Ted Cruz, who tweeted, "Here are words I’ve never said before: [Ted Lieu] is right."
