House GOP, joined by 11 Dems, vote to overturn Biden-Harris rule banning gas-powered tankless water heaters
Despite knowing full well that American voters decisively chose a different route for the country in November, the outgoing Biden-Harris administration used its final days and weeks to ram through as much of its progressive agenda as possible at the last moment in terms of new rules and regulations.
That included an Energy Department rule passed in December to effectively ban natural gas-powered tankless water heaters within the next five years, but House Republicans, joined by nearly a dozen Democratic colleagues, just voted to overturn that new rule, Fox News reported.
The rule, which was set to go into effect in March, was ostensibly aimed at increasing energy efficiency standards for water heaters but realistically would have done little more than disrupt the market and limit choices for consumers while saddling them with higher costs.
Biden admin's "radical energy decisions" harmful for manufacturers and consumers
It was less than a week ago that Frank Windsor, the president of the Georgia-based Rinnai America Corporation that manufactures tankless water heaters, warned Fox Business viewers of the Energy Department's new rule that was issued at the tail end of the Biden-Harris administration.
The rule would effectively ban a "very efficient and highly effective technology for water heating," Windsor said, and noted, "The scary thing is most Americans don't understand what's going on with these, I would describe, radical energy decisions that people are making that are going to have far-reaching impacts on consumers."
He further cautioned that the rule would have a "direct impact" on his company's 500+ employees as well as on consumers in terms of limited choices and higher prices.
Windsor, joined by nearly two dozen interest groups and Republican state attorneys general, filed a lawsuit to block the rule from taking effect, but at the same time also garnered attention from Republican members of Congress, who had the idea of using the Congressional Review Act to legislatively reverse the rule rather than rely upon the courts to do so.
Resolution passed with bipartisan support
Rep. Gary Palmer (R-AL) introduced in January a bill to overturn the Biden-Harris Energy Department's rule banning natural gas-powered tankless water heaters and said in a floor speech before a vote on Thursday that the "cold rhetoric" of Democrats would result in "cold homes and cold water," per Fox News.
"The American people were tired of being told what to do, what they could buy, what they could wear, what they could use," he continued. "That's why I introduced this resolution, because we're determined to restore a quality of life in this country that we enjoyed before the Democratic Party took over the White House, and the House and the Senate."
Once the votes were fully tallied on H.J.Res.20, the measure was declared passed with a final vote of 221-198, and according to the Office of the Clerk, the "Yeas" included 210 Republicans plus 11 Democrats, while the 198 "Nays" were all Democrats. Of note, there were two Republicans who voted "present," and there were 12 members, six Republicans and six Democrats, who didn't cast a vote at all.
Trump has signaled that he'll sign the bill into law
"In November, the American people gave the Republican Party a mandate to put the people first. By passing H.J. Res 20, we are fulfilling that mandate," Rep. Palmer said in a statement after the vote. "This is a major step towards undoing the previous administration’s attack on home appliances and reinstating the importance of consumer choice."
"Not only does this bill protect gas water heaters, but it protects all natural gas appliances. I look forward to seeing this bill pass in the Senate and eventually land on President Trump’s desk," the congressman added.
It seems likely that the Republican-controlled Senate will pass Palmer's bill, and barring any substantial changes that might be made by amendments, it has already been made clear by the White House that President Trump will gladly sign the bill into law once it reaches him.
"This rule’s impact on the water heater market could set a dangerous precedent for further restrictions on natural gas appliances, making it harder for American home owners to maintain affordable living standards. The rule promotes more expensive condensing gas water heaters and creates hurdles for remodeling and replacement projects," the White House said in a Statement of Administrative Policy. "If this bill were presented to the President in its current form, his advisors would recommend that he sign it into law."
