Judge denied Hunter Biden's request to have firearm charge dismissed

A plea made by Hunter Biden's attorneys to have a firearms charge against him dismissed was denied by a federal judge on Friday.

According to a report by Fox News, the attorneys for the first son asserted that the lawsuit is politically motivated.

As a result of the United States District Judge Maryellen Noreika's decision to deny all of Biden's motions, which highlighted what the petitioners claimed was selective and spiteful prosecution, the matter has been moved forward to reach the trial stage.

The Accusations

The son of President Joe Biden is being accused of lying on a federal document about his drug use when he purchased a pistol in October of 2018.

This is a time period in which he has admitted to suffering with an addiction to crack cocaine. However, despite prior admissions, the president's son has pleaded not guilty.

Hunter Biden has admitted that he struggled with substance misuse during that time period; nevertheless, his legal team has stated that he did not violate any laws. Additionally, there have been no charges that would have been brought against him if he had been a first-time offender who was not violent.

An immunity provision from an initial plea that was rejected was publicly criticized by Republicans, including former President Trump, as a "sweetheart deal."

His attorneys have alleged that the prosecutors gave in to political pressure and caved to the politics of the issue . The prosecution has denied that the case is caused by political considerations.

Constitutional Questions

There has been a challenge to the constitutionality of the gun charges, but Noreika has not yet made a decision on that particular issue.

The selection of jurors for the trial is scheduled to take place during the week of June 3rd.

There is still a possibility that Hunter Biden will be tried for tax charges on June 20 in the state of California. In addition, the legal team representing Biden intends to file an appeal against the decision of the judge to reject a motion to dismiss the accusations.

"Notice is hereby given that Robert Hunter Biden hereby appeals to the United States Court of Appeals for the Ninth Circuit," the court document giving notice of the interlocutory appeal states.

It has been stated that Hunter Biden was involved in a scam that lasted for four years and was designed to evade paying taxes totaling $1.4 million while he was living an affluent lifestyle.

This particular case is slated to go to trial from the end of June until the middle of July.
