Trump attorney on indictment: we will look 'to depose people'

Alina Habba, one of former President Donald Trump's attornies, says that she plans "to depose people" in relation to special counsel Jack Smith's indictment of Trump. 

Habba said as much during an appearance on Breitbart News Daily. 

There, Habba spoke about Smith's indictment of Trump over Trump's alleged mishandling of classified documents after he left the White House.

Trump has pled "not guilty" to the 37 charges that Smith has brought against him. The charges include willful retention of national defense information, conspiracy to obstruct justice, withholding a document or record, corruptly concealing a document or record, concealing a document in a federal investigation, a scheme to conceal, and false statements.

"Opportunity to depose people"

Habba told Breitbart, "we also need a fair opportunity to depose people and see what their answers are to some of the things we have questions about."

Deposition is an oral proceeding, which takes place outside of the courtroom, wherein an attorney questions an individual under oath on the record.

Habba did not go into too much detail about who she plans to depose and about what questions she will ask them. But, she did say that she will ensure that "there will be an explanation for everything."

Habba takes aim at Smith

During the interview, Habba also targeted Smith by referring to him as a "Democrat activist."

Trump, himself, has also been targeting Smith, referring to Smith as "deranged" and pointing out Smith's deep Democratic ties, ties that go at least back to the Obama Administration, where Smith was a DOJ prosecutor.

Trump has especially highlighted the Democratic ties that Smith has through his wife, Katy Chevigny. Chevigny has repeatedly donated to President Joe Biden and she has even produced the Michelle Obama documentary Becoming. 

For these reasons and others, Trump has referred to Smith as a political "hit man," tasked by U.S. Attorney Merrick Garland and, ultimately, Biden, with preventing Trump from winning the U.S. presidency again in 2024.

Habba compared Smith going after Trump to her going after Biden or Hillary Clinton, noting that it would be equally unfair for her to do so given her political alliance with Republicans.

Trump lawyer troubles

If you have been following the Trump indictment story, you may have heard that Trump has been having a hard time finding lawyers. This is not because no lawyer wants to represent him, but, rather, it is because left-wing groups have threatened any lawyer who represents Trump with disbarment.

As for why Habba has not backed down, as other lawyers have, she said, "I don’t mind being a punching bag… because what we’re doing is so important."
