Trump lawyer says judge's 'family has a vested financial interest in this case'

Former President Donald Trump hush-money trial is being overseen by New York state Judge Juan Manuel Merchan.

Yet during a recent interview with Breitbart News Daily, Trump lawyer Jesse Binnall laid out the reasons why Merchan needs to be disqualified. 

Merchan's daughter runs a Democratic consulting firm

Binnall pointed out that Merchan's "family has a vested financial interest in this case, or … the fact that the case is ongoing."

That was a reference to the fact that the judge's daughter is chief operating officer and president of Authentic Campaigns, a Democrat-aligned political consulting firm.

According to its website, Authentic Campaigns' clients have included President Joe Biden, Michigan Democratic Gov. Gretchen Whitmer, Oregon Democratic Gov. Tina Kotek, and California Democratic Rep. Adam Schiff.

What's more, the New York Post reported that the company used Trump's trial in a fundraising campaign on Schiff's behalf.

Defense attorney notes that judge made a campaign donation to Joe Biden

Binnall also stressed that Merchan has previously donated money to President Biden's campaign, something the lawyer described as being "highly unusual."

"I've never known a judge before who’s made a political donation while he’s been on the bench," the defense attorney asserted.

"But the fact that he did make a political donation, showing where his political allegiances lie, and then staying on a case that is having a huge impact on a presidential election is extremely improper," Binnall continued.

"Not just because it shows that he's biased, it shows his appearance of partiality, and we in this country have lived for about 250 years under the rule of law," the lawyer pointed out.

Trump defense team filed a motion for Merchan to recuse himself

The Washington Examiner reported earlier this month that Trump's defense team filed a motion asking Merchan to recuse himself.

"The manner in which Authentic and Ms. Merchan are marketing the company, and making money, through expressions of animus toward President Trump has created a prohibited appearance of impropriety," it read.

Trump spokesman Steven Cheung made a similar argument to the New York Post, stating, "Authentic Campaigns, and thus the judge's daughter, is actively making money from this sham attack against President Trump, rendering Judge Merchan conflicted out."

For his part, Merchan dismissed Trump's claims of bias in an interview in March with the Associated Press, saying, "There's no agenda here. We want to follow the law. We want justice to be done. That's all we want."
