Judge recuses himself from Trump defamation case

The judge overseeing the so-called "Central Park Five" case, involving President-Elect Donald Trump, has recused himself. 

This comes, according to Bloomberg Law, after Trump's legal team asked Judge Michael Baylson to step aside, citing a conflict of interest.

Baylson has now agreed to do so, meaning that the case will continue without him.

This is being considered a big win for Trump.

Per the outlet:

The case stems from the 1989 beating and rape of a female jogger in New York. Trump placed full-page newspaper ads calling for the death penalty for the defendants. More than 20 years later, in 2002, the five men who spent between six and 13 years in prison, were exonerated using DNA evidence. The plaintiffs claim Trump has continued to assert their guilt.

Accordingly, they have been a defamation case.

Trump asks Baylson to step aside

Recently, Trump's legal team called upon Baylson to step aside.

Bloomberg explains:

Trump and his attorneys Thursday sought the “immediate recusal” of Senior Judge Michael Baylson. They cited a Nov. 13 disclosure in the case by one of the plaintiff’s lawyers, detailing his and his firm’s relationship with the judge. The attorney Shanin Specter said he has “personally" represented both Judge Baylson and his wife.

In other words, there appears to have been a fairly clear conflict of interest in the case.

Baylson recuses himself

Baylson, according to the Daily Caller, has now agreed to recuse himself from the case.

Per the outlet:

U.S. District Judge Michael Baylson, appointed by former President George W. Bush, recused himself from the case after it was revealed that he has long-standing friendships with Shanin Specter, the group’s lead attorney, who has also represented him and his wife in previous legal issues, according to The Hill.

The Daily Caller goes on to report that "The litigation will be transferred to another judge within the U.S. District Court for the Eastern District of Pennsylvania, where the lawsuit was initially filed." At the time of this writing, it is still not known who is it who will replace Baylson in the case.

Trump and his team have not released a statement on the recusal decision. The Daily Caller notes that "members of the Central Park Five have actively opposed Trump [in the 2024 presidential election." They did so, among other things, by making "appearances at the Democratic National Convention and other campaign-related events."
