Dems trying to push Justice Sotomayor out
Some Democrats are currently trying to get U.S. Supreme Court Justice Sonia Sotomayor to resign.
This is according to a new report from Fox News.
At the time of this writing, it appears unlikely that Sotomayor is going to cave to the pressure. But, one can never say for sure.
To understand what is going on here, please read on.
Background
The reader will likely remember what happened during the Obama Administration with the late Justice Ruth Bader Ginsburg.
Back then, Ginsburg was facing significant pressure from the Democrats to resign. The concern was about the possibility that Ginsburg, due to her health, might have to step away from the court during a Republican administration allowing a Republican president to replace her - a liberal justice - with a conservative one.
This, of course, is exactly what ended up happening, and, ever since then, the Democrats have been concerned about the possibility of history repeating itself.
This is the reason why the Democrats are currently trying to get Sotomayor to step down. She is the third oldest Supreme Court Justice and reports in recent years have raised questions about her health.
Accordingly, the Democrats want her to step down before the Biden administration leaves office so that President Joe Biden - rather than incoming President Donald Trump - could replace her.
Will it happen?
At the time of this writing, we do not know the answer to this question. Some left-leaning outlets are suggesting that the possibility of this happening is almost zero.
CBS News, for example, reports, 'Sotomayor hasn't responded publicly to the chatter about retirement, and she did not return a request for comment about her future. She remains an active questioner during oral arguments and has become known for biting dissents in hotly contested cases."
In other words, the outlet is attempting to argue that Sotomayor is unlikely to resign because she is very active. The outlet also goes on to point out other things such as the fact that Sotomayor is currently a decade younger than Ginsburg was when she faced calls to resign.
A lot of this, though, is probably beside the point, which is that there is currently a major pressure campaign being put on Sotomayor. The question is not what she is currently doing on the court, but, rather, whether she will actually be able to resist this pressure.
Time will tell, but if Sotomayor were to leave during a Trump administration that would be really bad news for the Democrats. Trump has already put three justices on the court, which has a conservative majority for the first time in many years.
