Federal judge blocks Biden administration's Title IX gender identity rule in four states

The Department of Education caused controversy this spring with new Title IX rules which redefined the term sex to include gender identity.

While the Biden administration's move has massive implications for school sports, locker room policies, and pronoun usage, a federal judge has shut it down. 

Judge blocks enforcement of rule change in four states

According to Just the News, federal Judge John Broomes ruled on Tuesday in favor of attorneys general from Kansas, Alaska, Utah, and Wyoming who were seeking an injunction to block the new definition from being enforced in their states.

The Republican officials maintained that Title IX was intended to shield biological females from discrimination in education, a position with which Broomes agreed.

"The legislative history [of Title IX] supports a finding that the term 'sex' referred to biological sex," the Trump appointee wrote.

Focus was on "the unequal treatment between men and women"

"One of the principal purposes of the statute was to root out discrimination against women in education," Broomes pointed out.

"The legislative history shows that Congress was concerned about the unequal treatment between men and women for admissions opportunities, scholarships, and sports," he insisted.

In addition to the four attorneys general, the Biden administration's Title IX interpretation was also being challenged by Moms for Liberty, Young America’s Foundation, and Female Athletes United.

Moms for Liberty founders Tiffany Justice and Tina Descovich provided a statement to Just the News in which they welcomed Broomes' decision.

Conservative group says ruling was "the correct call"

"Gender ideology does not belong in public schools and we are glad the courts made the correct call to support parental rights," the statement declared.

Justice and Descovich further pledged that their organization "will always stand up for the rights of parents and the protection of children."

"All parents must have their voices heard and their right to raise their own children is part of the very fabric of a free America," the activists continued.

Justice and Descovich went on to assert that "[t]he federal government has no right to claim our children as their own or to push parents out of the classroom."
