Report: FBI form subpoenaed by Oversight Committee is based on info uncovered by Giuliani in Ukraine

House Oversight Committee Chairman James Comer (R-KY) has threatened to hold FBI Director Chris Wray in contempt of Congress for refusing to comply with a subpoena to turn over a specific internal document that alleges a bribery scheme involving then-Vice President Joe Biden and a foreign national.

Recent reporting indicates that the FBI document Comer seeks contains unverified information first turned over to the Justice Department by former New York City Mayor Rudy Giuliani, according to MSNBC.

Recall that in late 2019/early 2020, while then-President Donald Trump faced his first impeachment, his then-personal attorney Giuliani traveled to Ukraine and other locales to seek out evidence of alleged Biden family corruption and then turned the information he gathered over to the DOJ and FBI upon his return.

Subpoenaed FBI document based on info uncovered by Giuliani

At the center of the dispute between Chairman Comer and Director Wray is an internal FBI document known as an FD-1023 form that is used to record interactions with sources and the raw information they provided without any effort to corroborate or verify said information.

According to CNN and anonymous sources, the particular FD-1023 that Comer is after first originated in 2020 from the information that Giuliani provided to the DOJ and FBI about the Biden family's alleged corruption and influence peddling in foreign nations.

At the time that Giuliani turned over that material, a majority of it obtained from sources in Ukraine, then-Attorney General William Barr was skeptical and assigned then-U.S. Attorney Scott Brady of Pittsburgh, Pennsylvania to oversee efforts by the FBI to double-check and verify the information provided to them by Giuliani.

Indeed, the Associated Press reported in Feb. 2020 that AG Barr told reporters that he had cautioned federal investigators to be "very careful" with any information received that may have originated from Ukraine, even as he acknowledged that there was an "open door" policy to accept information from sources that may indicate criminal activity.

"We have to be very careful concerning any information coming from the Ukraine," Barr said at that time. "There are a lot of agendas in the Ukraine, a lot of cross currents. And we can’t take anything we received from Ukraine at face value."

The document confirmed, contempt charge threatened

Now, per CNN's sources, it is reported that the FBI document demanded by Chairman Comer stemmed from that probe led by former U.S. Attorney Brady, and while it reportedly does document the claims of a foreign bribery scheme involving then-Vice President Biden, it doesn't contain any corroboration or proof that those claims are actually true.

Nonetheless, Comer insisted that the form be turned over to his committee and, when FBI Director Wray failed to comply with a subpoena for that document, threatened to proceed with contempt of Congress charges that prompted Wray to finally acknowledge the existence of the form, though he offered only to allow Comer to come and look at it and continued to refuse to hand it over as requested.

"Today, FBI Director Wray confirmed the existence of the FD-1023 form alleging then-Vice President Biden engaged in a criminal bribery scheme with a foreign national," Comer said in a May 31 statement. "However, Director Wray did not commit to producing the documents subpoenaed by the House Oversight Committee."

"While Director Wray -- after a month of refusing to even acknowledge that the form existed -- has offered to allow us to see the documents in person at FBI headquarters, we have been clear that anything short of producing these documents to the House Oversight Committee is not in compliance with the subpoena," he added. "If the FBI fails to hand over the FD-1023 form as required by the subpoena, the House Oversight Committee will begin contempt of Congress proceedings."

Wray ignored a lawful subpoena, regardless of the motivations behind the said subpoena

The MSNBC report, which is actually a biased op-ed that blithely dismissed Giuliani and virtually all the information he uncovered in 2019/2020 as questionable or untrue, went on to accuse Chairman Comer of deliberately sparking a controversy over a document that he knows is unverified and potentially untrue in order to harm President Joe Biden politically.

That may well be, but it doesn't change the fact that Director Wray has blatantly ignored and refused to comply with a lawful subpoena from a GOP-led congressional committee that, given the FBI's increasingly apparent track record of partisanship over the past several years, would prefer to investigate the unverified claims on their own instead of blindly accepting the dubious word of the FBI and DOJ on this particular matter.
