Federal judge blocks new Texas law that allows for arrest of illegal migrant crossers

Since the Biden administration or Democrats in Congress seem to continually turn a blind eye to the immigration crisis at the southern U.S. border, some states, like Texas, have taken matters into their own hands. 

One of the ways Texas took action, as applauded by many, was by enacting a new state law that allows Texas law enforcement officials to arrest migrants who cross the Texas-Mexico border illegally.

The law, which many believe could significantly reduce illegal border crossings, is known as Senate Bill 4, and was to take effect as of last Tuesday.

According to Texas Tribune, unsurprisingly, the law was blocked by a federal judge just as it was supposed to take effect.

What happened?

U.S. District Judge David Ezra, an Austin-based federal judge, issued a preliminary injunction that blocks the law from taking effect while legal battles inevitably play out in the courts.

Again, unsurprisingly, the U.S. government and several immigration advocacy groups sued Texas in an attempt to block the law from taking effect.

The Texas Tribune noted:

Ezra said in his order Thursday that the federal government “will suffer grave irreparable harm” if the law took effect because it could inspire other states to pass their own immigration laws, creating an inconsistent patchwork of rules about immigration, which has historically been upheld as being solely within the jurisdiction of the federal government.

The judge added, "SB 4 threatens the fundamental notion that the United States must regulate immigration with one voice."

The bill was signed by Texas Gov. Greg Abbott in December of last year.

Texas doubles down

The Texas governor made clear that he's ready to take the situation all the way to the U.S. Supreme Court if necessary, saying Texas "will not back down in our fight."

He added in a social media post that he wasn't concerned about the federal judge blocking the law, as he predicted it was "expected."

Abbot added, "Texas has solid legal grounds to defend against an invasion."

It'll be curious to see how if the law is ultimately taken to the high court for a ruling. Many legal observers believe it will. Only time will tell.
